1. What is Social Security Disability?

According to the Social Security Act, Social Security Disability is defined as "the inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death, or has lasted or can be expected to last for a continuous period of not less than 12 months."

Although the disability program has one set of rules to determine who is disabled, the program is really comprised of two separate programs. Disabled people with sufficient quarters of coverage from their work histories usually qualify for the SSDI program, whereas indigent people without sufficient quarters of coverage usually qualify for SSI or Supplemental Security Insurance. 2. Who can get disability benefits?

If you are unable to work as a result of a medical condition, and you will be out of work longer than a year you may be disabled if you are eligible for one of the two programs. A working person who can no longer work job because of an illness or injury, may be eligible for SSDI disability benefits. A disabled worker must have paid into the Social Security Administration for a long enough period and in large enough amounts to be considered insured under SSDI. If you are not eligible for SSDI you may be eligible for SSI so long as you meet the resources guidelines. To be disabled under either SSDI or SSI you must not be gainfully employed at substantial levels. You must also be under a disability which has lasted or is expected to last 12 months or more, and your disability must be severe enough to keep you from working. 3. What happens if my claim for Social Security Disability is denied?

If Social Security denies your claim or you disagree with any part of their decision, you may appeal the decision. You have 60 days from the time you receive your denial letter to file an appeal.
